I am writing to gain some clarification on the European Commission’s position with regard to:
1. The legality of the law, Government Gazette, A’ 84/13.04.2020, passed by the Greek government in conflict with European Commission Regulation (EC) No 261/2004.
2. The failure of Aegean Airlines to comply with 261/2004 with respect to providing a full cash refund for flights cancelled by the airline.
3. The failure of the responsible Greek body, the Hellenic Civil Aviation Authority, to take action against Aegean Airlines to enforce compliance with 261/2004.
In the interests of brevity of this email, the details of my case are set out in the website I have created for the purpose. It contains transcripts of my communications with Aegean Airlines and with the Hellenic Civil Aviation Authority. You can view the website at http://AegeanUnfAir.com.
I have followed the procedure prescribed by the European Commission in respect of requesting a refund from the airline and sending an AIR PASSENGER RIGHTS – EU COMPLAINT FORM to both the airline and the Hellenic Civil Aviation Authority. Both organisations have rejected my requests for a cash refund.
My next course of action is to request a ‘charge-back’ from my credit card company under the provisions of Directive 2014/17/EU of the European Parliament and of the Council, enshrined in UK law in section 75 of the Consumer Credit Act 1974.
Before I can do this, I need to demonstrate that I have no other form of redress from the airline. To this end, I would request a statement from the European Commission to the effect that:
1) The European Commission has no plans to take action against the Greek government to rescind Government Gazette, A’ 84/13.04.2020.
2) The European Commission has no plans to take action against the Hellenic Civil Aviation Authority to force it to uphold its duty in respect of European Commission Regulation (EC) No 261/2004.
3) The European Commission has no plans to take action directly against Aegean Airlines to enforce its compliance with European Commission Regulation (EC) No 261/2004.

The purpose of this Facebook page is to gather ‘signatures’ of people supporting the following petition to be served upon Adina Vălean, the European Commissioner for Transport. You do NOT need to be an Aegean Airlines ticket-holder who is owed money by the airline to ‘sign’ this petition. It is sufficient that you should feel that the rule of law must be applied equally across individuals, businesses and governments, without fear or favour.
We, the undersigned, request and require the European Commission to uphold and enforce the terms of ‘European Commission Regulation (EC) No 261/2004‘ with regard to the Greek law ‘Government Gazette, A’ 84/13.04.2020‘ which attempts to override provisions of the higher European law.
In respect of Article 8 of ‘European Commission Regulation (EC) No 261/2004‘ i.e. the right to choose ‘reimbursement with seven days’, we require the following of the European Commission in order to ensure the rights of individual citizens are not subordinated by the interests of influential big business or governments with vested interests.
1. To take swift, firm and decisive action to force the Greek government to rescind those clauses of ‘Government Gazette, A’ 84/13.04.2020‘ which are in conflict with ‘European Commission Regulation (EC) No 261/2004‘.
2. To take legal action against Aegean Airlines to force its adherence to the higher European law in respect of providing timely reimbursement for cancelled flights.
3. To censure the Hellenic Civil Aviation Authority over its failure to carry out its duty as the appointed Greek ‘national authority’ charged with ensuring compliance with ‘European Commission Regulation (EC) No 261/2004‘4.

DO NOT TRUST YOUR MONEY OR YOUR SAFETY WITH AEGEAN AIRLINES.
How can anybody trust that Aegean has the money to properly maintain and clean its aircraft when it has needed to steal money from its most loyal passengers just to keep its head above water? It’s a shameful, disgusting airline.
And don’t think the Greek government will enforce safety – they twisted EU law to pave the way for Aegean to steal our money – so they’ll allow ANYTHING to keep the fat cats’ investment in Aegean safe.
And don’t think the Hellenic Civil Aviation Authority will look after passengers’ safety. It’s a toothless tiger which rolled over in submission when told to by the Greek government.
I want NOBODY to accuse me of being anti-Greek. I love Greece and the Greek people. I’ve been travelling to the country for over 40 years and will continue to do so – several times a year. This present immoral Greek government will pass in time and I’ll never again fly with an airline possessing the morality of a sewer rat.
Why not sign our petition to the European Commissioner for Transport requesting that the EC force Greece and Aegean to abide by EU law?

Regulations
Regulations are of general application, binding in their entirety and directly applicable. They must be complied with fully by those to whom they apply (private individuals, Member States, EU institutions). Regulations are directly applicable in all the Member States as soon as they enter into force (on the date stipulated or, failing this, on the twentieth day following their publication in the Official Journal of the European Union) and do not need to be transposed into national law.
They are designed to ensure the uniform application of Union law in all the Member States. Regulations supersede national laws incompatible with their substantive provisions.
